1. Acceptance of Terms

By accessing or using CaptchaKit ("the Service"), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, you must not use the Service. CaptchaKit is operated by didyu ("we", "us", "our"). We reserve the right to modify these Terms at any time; your continued use constitutes acceptance.

2. Description of Service

CaptchaKit provides arcade mini-game CAPTCHA widgets that website owners embed to verify human users. Upon purchase, you receive a site key, embed code, and API key to integrate into your forms. Verification tokens are validated server-side via our API. We make no guarantee of uninterrupted availability and may update, modify, or discontinue any feature with reasonable notice.

3. Account Registration

You must provide accurate information when creating an account. You are solely responsible for all activity under your account and for maintaining the security of your credentials, site keys, and API keys. We are not liable for any loss resulting from unauthorized access caused by your failure to protect your credentials. Notify us immediately of any suspected breach via our contact form.

4. Purchases and Payments

All purchases are one-time payments that grant a perpetual, non-exclusive, non-transferable license to embed the purchased game(s). Payments are processed by Stripe. Prices are subject to change without notice for new purchases; existing licenses are unaffected. All sales are final. Refunds are granted solely at our discretion within 7 days of purchase, only where the widget provably fails to function as described despite proper integration.

5. Permitted Use

You may embed CaptchaKit widgets on any website or application you own or lawfully operate. You may not:

• Resell, sublicense, redistribute, or transfer site keys or API keys to unrelated third parties.
• Use the Service to protect or facilitate illegal content or activities.
• Attempt to reverse-engineer, copy, or clone the game logic or token system.
• Use automated means to generate or bypass verification tokens.
• Overload our infrastructure through excessive or abusive API usage.

Violation of these restrictions may result in immediate account suspension without refund.

6. API and Rate Limits

We reserve the right to impose rate limits on verification requests to protect service stability. Accounts found to be generating automated verification traffic, scraping, or attempting to circumvent rate limits will be suspended immediately and permanently without refund or appeal.

7. Intellectual Property

All game logic, artwork, code, and branding remain the exclusive property of didyu. Your purchase grants a limited embed license only. Nothing in these Terms transfers any ownership rights to you. You may not use our name, logo, or branding without prior written permission.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will prevent all automated bot activity. No CAPTCHA system provides absolute security.

9. Limitation of Liability

To the maximum extent permitted by applicable law, didyu and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service, including but not limited to loss of revenue, data, or business opportunities. Our total cumulative liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless didyu from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which didyu operates, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction, and you consent to personal jurisdiction therein.

12. Changes to Terms

We may update these Terms at any time by posting a revised version on this page. Material changes will be communicated to registered users. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
